Limitation of Liability
This policy is incorporated into our Terms of Service and applies to all Services provided or arranged by RUSLAN WITH PARTNERS LLC DBA AmeriLink Transit.
1. Maximum Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US FOR THE SPECIFIC TRIP OR JOB GIVING RISE TO THE CLAIM.
2. Excluded Damages
We are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including without limitation: missed flights or connections; lost business or profits; emotional distress; loss of data; hotel, airline, or third-party fees; or damages arising from delay, no-show of third-party partners beyond our reasonable control, traffic, weather, road conditions, acts of God, strikes, governmental action, or force majeure.
3. Personal Property & Cargo
Unless a separate written cargo agreement with declared value is executed and additional charges paid, personal property and freight travel at the Client’s sole risk. You should insure valuable items. We are not responsible for items left in vehicles after Service completion.
4. Third-Party Providers
When Services are performed by independent contractors or partner carriers, those parties are responsible for their own operations, licensing, and insurance. Our role may be limited to arranging the booking. We do not waive partner defenses or expand liability beyond Section 1.
5. Assumption of Risk
Ground travel involves inherent risks. By using the Services, you acknowledge those risks and agree that remedies are limited as stated herein, except where liability cannot be limited under applicable law (including liability for death or personal injury caused by our gross negligence or willful misconduct, where such limitation is prohibited).
6. Claims Period
Any claim must be submitted in writing to rnazarevskiy@gmail.com within thirty (30) days after the Service date, and any lawsuit must be filed within one (1) year after the claim accrues, unless a longer period is required by non-waivable law.
7. Severability
If any provision is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
